US federal court found Fairchild Semiconductor infringes Power Integrations patent

The court ruled that Fairchild Semiconductor "blindly copied" Power Integrations' "epoch-making" technology; Power Integrations would ask for increased damages.

On July 23, 2010, Power Integrations (NASDAQ: POWI) announced that the US Federal District Court had determined that Fairchild Semiconductor had intentionally infringed its technology patents. After a jury trial in October 2006, the court found that Fairchild Semiconductor infringed Power Integrations' four technical patents; in September 2007, the jury rejected Fairchild's question about the validity of the patent; the court in 2008 In September, Fairchild Semiconductor was dismissed from questioning the enforceability of the law; in June 2009, after trial by the judge, the court found that Fairchild’s intentional infringement was true. Finally, the four patents involved in this case were deliberately infringed.

The US District Court for the District of Delaware stated in its judgment that Power Integrations provided clear evidence that the other party was deliberately infringing, and Fairchild Semiconductor "has blatantly copied the patented functions of Power Integrations." The court further pointed out that Fairchild Semiconductor realized the importance of Power Integrations' patents for the industry, and they internally referred to these patents as "major patents" for "epoch-making" technology. In December 2008, the court awarded Power Integrations $6.1 million in damages and interest based on the initial determination of the infringement. According to the court's deliberate infringement ruling, Power Integrations is now ready to seek to increase damages and attorneys' fees. The court’s initial ban on more than 100 Fairchild products infringing products in December 2008 remains valid. Appeals can still be filed against the outcome of the trial.

Commented Balu Balakrishnan, President and CEO of Power Integrations, said: "We are gratified that the court has determined the deliberate infringement of Fairchild Semiconductor, and we are now ready to seek the maximum financial compensation. We can become the leader in the industry. Thanks to the numerous innovations and investments we've made over the past 20 years, we expect our competitors to respect our intellectual property rights protected by patents."

Power Integrations has not yet finalized a legal action against Fairchild Semiconductor in May 2008 and November 2009, respectively. The two lawsuits alleged that the other party infringed Power Integrations' five patents, two of which have now been identified as deliberate violations by the District Court. Power Integrations is seeking additional damages and requires the court to issue a sales ban on Infringing Products of Fairchild Semiconductor/System General in addition to the existing ban.

The main circuit of the equipment is the full bridge controlled circuit and the trigger circuit is the programmable integrated circuit. The phase-shifting, fixed width and modulation of the pulse are all digitized, and it does not need any adjustment for the section of the trigger. It has the features of high reliability, high pulse symmetry, strong anti-interference ability, quick reaction, as well as the advantages of no heat-generating, constant current, energy-saving which is compared with the discharge with the electrical resistance.
